D\u2019ailleurs, dans la plupart des provinces, les lois r\u00e9gissant les normes du travail contiennent des dispositions selon lesquelles les personnes, soci\u00e9t\u00e9s ou organisations travaillant en \u00e9troite collaboration ne constituent qu\u2019un seul employeur.&nbsp;<\/p>\n<h3><strong>D\u00e9finition du concept\u00ad<\/strong><\/h3>\n<p>Pour d\u00e9terminer si des entit\u00e9s constituent un employeur commun, il faut d\u00e9cider s\u2019il existe un \u00ab\u00ad degr\u00e9 de relation suffisant \u00bb entre elles. Pour ce faire, on examine l\u2019actionnariat individuel, l\u2019actionnariat des soci\u00e9t\u00e9s, l\u2019imbrication de la direction et le contr\u00f4le commun. Bref, si les actionnaires, les dirigeants et les administrateurs au sein d\u2019un groupe d\u2019entreprises sont les m\u00eames et qu\u2019ils exercent un contr\u00f4le commun sur certains aspects de l\u2019emploi d\u2019une personne, ils risquent d\u2019\u00eatre consid\u00e9r\u00e9s comme des employeurs communs et reconnus conjointement responsables des pr\u00e9judices caus\u00e9s \u00e0 un employ\u00e9 cong\u00e9di\u00e9 de fa\u00e7on injustifi\u00e9e.<\/p>\n<p>Le concept d\u2019employeur commun est invoqu\u00e9 la plupart du temps dans des cas d\u2019insolvabilit\u00e9 ou de dissolution, quand un employ\u00e9 r\u00e9clame des dommages-int\u00e9r\u00eats pour cong\u00e9diement injustifi\u00e9 et ne peut les obtenir facilement aupr\u00e8s de son employeur principal. La requ\u00eate est alors redirig\u00e9e vers des soci\u00e9t\u00e9s ou personnes connexes qui sont suffisamment li\u00e9es \u00e0 l\u2019employeur.<\/p>\n<p>Ainsi, un contrat d\u2019emploi avec une entreprise n\u2019emp\u00eache pas les entreprises qui y sont li\u00e9es de devoir assumer la responsabilit\u00e9 de certaines d\u00e9cisions. Ce type de demande repose sur les faits, c\u2019est-\u00e0-dire sur ce qui se passe r\u00e9ellement dans l\u2019organisation, plut\u00f4t que sur la forme, soit ce qui figure dans les documents. En outre, les tribunaux se pr\u00e9occupent davantage de garantir le respect des droits des employ\u00e9s que de pr\u00e9server l\u2019ind\u00e9pendance des entit\u00e9s commerciales.<\/p>\n<h3><strong>Implications concr\u00e8tes<\/strong><\/h3>\n<p>Ce qu\u2019il faut en retenir? Les propri\u00e9taires et employeurs qui font partie d\u2019organisations solidaires comme les soci\u00e9t\u00e9s de portefeuille ou d\u2019exploitation doivent reconna\u00eetre que ce n\u2019est pas parce qu\u2019un employ\u00e9 a un contrat avec une entit\u00e9 que les autres entit\u00e9s ne peuvent \u00eatre tenues responsables de quoi que ce soit si ces entit\u00e9s exercent un contr\u00f4le commun. Toutefois, quand une soci\u00e9t\u00e9 de portefeuille ne participe qu\u2019\u00e0 titre d\u2019actionnaire, il y a peu de risque qu\u2019on \u00e9tablisse une responsabilit\u00e9 et un contr\u00f4le communs.
